Wholey Crêpe® has a gift voucher/ card where customers wish to share the experience of Wholey Crepe with someone else.  If you wish to give a Gift Voucher/ Card, you can buy your card where Wholey Crêpe® trades*.   *Conditions of Use apply as per below

Conditions of Use:

Definitions

“Voucher Value” means the 17-digit number that appears on the back of your Gift Voucher;

“Wholey Crepe” means Wholey Crepe ABN 84 853 585 773 of 14A Cricklewood Way, Carine, Western Australia 6020;

“Gift Voucher“ means the Gift Voucher/ Card that you have purchased or received;

“Voucher Value” means, at any time, the portion of the initial value of your Gift Card which is unspent and can be accessed by using the Gift Card in accordance with these Terms of Use;

A reference to “we” or “us” is a reference to Wholey Crêpe;

A reference to “you” or “your” is a reference to the person who is in possession of the Gift Voucher at the relevant time for the purposes of these Terms of Use, or who authorises another person to do something with or to the Gift Voucher on their behalf.

Accepting the Gift Voucher and agreeing to these Conditions of Use

By purchasing, redeeming or attempting to redeem a Gift Voucher, you:

accept and agree to be bound by these Conditions of Use; and acknowledge that you have read and understood our Privacy and Security Notice.

Gift Voucher Inclusions & Exclusions

Inclusions

  • Gift Vouchers purchased by customers as a gift.
  • Gift Vouchers issued by Wholey Crepe as a promotional strategy or charitable purposes such as market raffle.  These issued Gift Vouchers will only be valid for three months.

Exclusions

General exclusions (all Gift Vouchers)

  • Purchases initiated by phone, email, post or fax (where accepted).
  • Gift cards cannot be used to purchase gift vouchers.

Transactions made with the Gift Voucher

How and where you can use the Gift Voucher

Your Gift Voucher may only be used during Wholey Crepe trading hours. The identity of the retailers who have agreed to accept the Gift Voucher may change from time to time. Each participating retailer will accept the Gift Voucher in accordance with these Terms of Use and any applicable law.

You acknowledge that the Gift Voucher may not be used:

  • to pay a store or credit account;
  • to purchase goods or services that a retailer is not permitted to supply to you (for example, a retailer cannot by law sell alcohol to you if you are under 18 years of age); and
  • for purchases over the Internet or by email, phone or fax.

How to purchase a Gift Voucher

Request a Gift Voucher from the point of sale operator.  Nominate the value you wish to be purchase on the Gift Voucher. A minimum of $10.00 and a maximum of $100.00 can be purchased for a Gift Voucher. Pay for your Gift Voucher and the transaction will be completed when the card is validated with the authorised signature. Gift Vouchers cannot be purchased by using a Gift Voucher.

Note: there may be a delay with the Gift Voucher activating in the system once loaded. During this delay, the Gift Voucher cannot be used for purchases or transaction enquiries.

Purchases with your Gift Card

Select goods from the menu and place your order with the point of sale operator.  Present your Gift Voucher when payment is required and surrender the voucher to the point of sale operator.  The operator will deduct the amount of the Gift Voucher from your order. No change will be given: no remaining balance on the card can be used in whole or part against future purchases.

You agree that we can reduce the Value by the value of all purchases of goods and services that are authorised by you.

Transactions are authorised by you by:

  • surrendering the Gift Voucher to the point of sale operator; or
  • giving a Wholey Crepe point of sale operator the Gift Voucher and authorising the transaction in some other way approved by Wholey Crepe. When you authorise a transaction:
  • you are confirming that the transaction correctly represents the purchase price of the goods or services obtained; and
  • you are agreeing to pay the amount of that transaction by the reduction of the Voucher Value.

Purchases exceeding the Gift Card value

Your Gift Voucher may only be used to make purchases up to the Voucher Value. If you wish to make a purchase for an amount that exceeds the Voucher Value, you must pay the excess using another payment method.

No cash advances

You cannot obtain any cash advance with your Gift Voucher or redeem your Gift Voucher for cash.

Validity and expiry of Gift Vouchers

Your Gift Voucher will be valid for use for one year from the date of issue**.  Any balance that remains on a Gift Voucher will not be available for use after the card’s expiry date. To check the expiry date of your Gift Voucher, please refer to the expiry date on the back of the Gift Voucher.

**Gift Vouchers issued by for promotional purposes (not purchased by customers) such as market raffle will only be valid for three months from the date of issue.

Re-issue of damaged Gift Vouchers

Re-issue of damaged Gift Vouchers is not available unless the Gift Vouchers are proven to be faulty or damaged as a result of the production process or otherwise due to the fault of Wholey Crepe, its agents or contractors.

Destruction of Gift Voucher with no value

Once the Voucher Value is used, the voucher will be retained by Wholey Crepe.  Your Gift Voucher cannot be reloaded or reused.

Lost or stolen Gift Voucher

Treat your Gift Voucher like cash. Lost or stolen vouchers will not be replaced or refunded.

Can I add more value to a Gift Voucher?

No, once a Gift Voucher has been purchased, the value on it cannot be increased.

Can I exchange my Gift Voucher?

You cannot exchange your Gift Voucher for a different denomination or type of Gift Voucher or expiry date or for another tender, cash or discount.

Can I cancel my Gift Voucher?

No, you cannot cancel your Gift Voucher.

Exchanging items purchased with a Gift Voucher.

Goods that are purchased solely, or in part with a Gift Voucher may be exchanged or returned subject to the exchange and returns policy of Wholey Crepe.

Wholey Crepe reserves the right to issue a Gift Voucher for goods returned that were originally purchased with a Wholey Crepe Gift Voucher instead of other tender, cash, or discount.

Your Gift Voucher, your responsibility

You are responsible for the use and safety of your Gift Voucher. You are liable for all transactions on your Gift Voucher, except to the extent to which there has been fraud or negligence by us or by any of our employees.

Changes to Conditions of Use

We reserve the right to change any of the terms contained in these Conditions of Use at any time where the change is required:

  • To add or remove participating service operating times where the Gift Voucher may be redeemed;
  • To add or remove goods or services which may be purchased with the Gift Voucher;
  • For infrastructural, systems, administrative or operational reasons or to prevent the occurrence of fraud or other unlawful or unacceptable conduct;
  • To comply with any contract, law, regulation or statute or order or judgment of any court, tribunal or other body having competent jurisdiction; or
  • Where we, acting reasonably, consider that it will not be to your detriment.

Our Privacy and Security Notice explains how we handle the personal information that we may collect from you with respect to Gift Voucher. If you do not have a copy and are unable to access the notice online at www.wholeycrepe.com.au/gift-voucher.

Errors and Complaints

Gift Vouchers

If you have reason to believe that an error has occurred in relation to your Gift Voucher, you should contact us.

Goods or services

Any complaints about goods or services purchased with a Gift Voucher must be resolved directly, preferably at the time of the concern.

Force majeure

To the extent permitted by law, we will not be liable to you for any loss or damage (whether direct or consequential), nor be in default under these Terms of Use, for failure to observe or perform any of our obligations under these Terms of Use for any reason or cause which could not, with reasonable diligence, be controlled or prevented. These causes include acts of God, acts of nature, acts or omissions of government or their agencies, strikes or other industrial action, fire, flood, storm, riots, power shortages or failures, sudden and unexpected system failure or disruption by war or sabotage, and other acts or omissions of third parties.

Applicable law

These Terms of Use are to be construed and enforced in accordance with the laws of Western Australia, Australia. Any dispute arising from your receipt or use of a Gift Voucher is exclusively subject to the jurisdiction of the courts of Western Australia, Australia.
